GENERAL TERMS AND CONDITIONS OF SALE

1. General points

​

1. The online shop www.mawoo.ch is a [service] offering of Made in Maple Sàrl, Freiburgstrasse 49, 3280 Morat, Switzerland.

2. Made in Maple SARL offers maple syrup-based food products under the MAWOO brand on the online shop www.mawoo.ch.

3. The General Terms and Conditions of Sale (hereinafter referred to as GTCS) govern all conditions and services between Made in Maple Ltd. and its customers.

2. Offer and conclusion of the contract

​

1. Made in Maple's offers in the online shop www.mawoo.ch are intended for customers who are of legal age and with a legal capacity to act and who are domiciled in Switzerland or Liechtenstein.

2. In the case of a sale by Made in Maple GmbH, the contract of sale is concluded directly between the customer and Made in Maple GmbH.

3. In order to place an order, the customer must be of legal age and have legal capacity. The customer must first log on to www.mawoo.ch with a personal customer account. In addition to the user name (e-mail address), the customer must also enter his/her first and last names, the address of the place of residence declared to the authorities, his/her date of birth, the desired language of communication and a valid telephone number. This information must be accurate and true. In the case of purchases via the individual customer account, the customer must also define a password. The customer assumes full liability for the use of the password and for all orders that are placed, even without the customer's knowledge, using the password.

3. Ordering and delivery

1. Orders are placed on the website www.mawoo.ch. By placing an order, the customer submits an offer by which he/she commits to purchase the selected products and accepts the General Terms and Conditions of Sale of Made in Maple SARL.

2. Made in Maple SARL will send an e-mail to the customer confirming the order. This e-mail corresponds to the acceptance of the order and constitutes the conclusion of the sales contract between the customer and Made in Maple SARL.

3. If it appears after confirmation of receipt of the order that an item is not available, Made in Maple SARL will contact the customer as soon as possible to find a solution (refund, substitution, postponement of shipment until the product is available).

4. Made in Maple SARL reserves the right, at its discretion, to refuse an order, particularly in the case of unpaid invoices, insolvency, non-compliance with delivery conditions or incorrect personal information.

5. The data recorded by Made in Maple SARL constitute irrefutable proof of the order or transaction.

6. The delivery time stated in the offer or in the confirmation of receipt of the order is provided as an indication only, without any obligation. In the event that Made in Maple SARL is unable to meet a delivery deadline, the customer may cancel the order by notifying the Customer Service department in writing within 30 days of confirmation of receipt of the order.

7. Made in Maple SARL. is entitled to make partial deliveries. If only a part of the ordered goods cannot be delivered, the customer is not entitled to cancel the entire order or to make additional claims.

8. Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein at the customer's own risk. In principle, the goods will only be delivered to the customer's address indicated in the order.

9. Shipping costs are free for all orders over 85 CHF. For orders below this amount, shipping costs depend on the total weight of the items ordered and are a minimum of CHF 4.90 and a maximum of CHF 13.00.

10. Once the order has been confirmed and shipped, no changes can be made.

11. The customer can change or cancel his/her order by contacting the Customer Service department by e-mail and provided that this request is received before the date of dispatch of the goods.

4. Checking the goods delivered

​

1. The customer shall check immediately whether the goods delivered/collected are as ordered, complete and in perfect condition. Damage to the delivered goods must be reported to the Customer Service department by e-mail or via the contact form on the mawoo.ch website as soon as possible, but at the latest within five calendar days of delivery. In the event of a complaint, all parts of the original packaging must be retained. The customer may only dispose of them with the written consent of Made in Maple SARL.

5. Prices

​

1. Made in Maple SARL has the right to modify the price of its products at any time. The price in force is the one published at the date of the order. Price changes that occur after the order is placed are not taken into consideration.

2. All prices published in the online shop are in Swiss francs, including VAT (value added tax). Additional costs (e.g. postage, packaging, surcharges for certain payment methods, transport guarantee) are not included in the price. They are listed separately and invoiced as described in the section “Ordering and Delivery”.

6. Terms of payment and retention of title

​

1. Payment is made at the time of ordering. The accepted means of payment are: Credit card (Visa and MasterCard), PayPal and bank transfer.

2. Made in Maple SARL can exclude one or the other of these means in general or for certain customers, without having to justify its decision. Made in Maple SARL is entitled to levy surcharges on certain payment methods. Made in Maple SARL reserves the right to inquire about the solvency of the customer.

3. In case of payment by invoice, the invoice and delivery addresses must be identical. Payment by bank transfer must be detailed here. If the customer is in arrears, Made in Maple SARL may also, without further notice, cancel or suspend all other orders until the debt has been paid in full. Any delay in payment will give rise to the deduction of interest on the outstanding balance and to the charging of administrative and legal costs incurred. Further claims for damages are expressly reserved. Furthermore, Made in Maple SARL is entitled to assign outstanding debts to external collection companies.

4. The delivered products remain the property of Made in Maple SARL until receipt of the full amount of the purchase (including all supplements). The customer shall take care of the products as long as they are the property of Made in Maple SARL.

7. Right of return, take back, and exchange

​

1. As a rule, the customer has no right of return, take-back or exchange.

8. Liability

​

1. The photos and texts illustrating and describing the products on this site are non-contractual and for information purposes only. Made in Maple SARL declines all liability for any errors or omissions in the photos or texts on this site.
2. Subject to mandatory Swiss law, no claim for damages relating to an order covered by these conditions may exceed the purchase price of the products which gave rise to the claim for damages.
3. In no event shall Made in Maple SARL be liable for any indirect, incidental or consequential damages of any kind arising out of or in connection with the products, their use, their sale or this site.

9. Force Majeur

​

1. Made in Maple SARL will do its utmost to fulfil its obligations but cannot be held liable for delays or non-delivery due to circumstances beyond its control, such as accidents, strikes, natural disasters or others that prevent the production and delivery of products.

10. Individualised advertising

​

1. In order to avoid unnecessary advertising, Made in Maple SARL only sends targeted advertising to customers with an active account. This is based on the analysis of the customer's purchasing behaviour. Made in Maple SARL has several options and means for sending individualised advertising, including (but not limited to) e-mail, post, telephone, text or multimedia messaging (SMS, MMS). By opening a customer account with Made in Maple SARL, the customer accepts individualised advertising. The customer can also withdraw by sending an e-mail to the address or using the contact form on the mawoo.ch website.

11. Data protection

​

1. By creating an individual customer account and/or using our website without registering, you accept the data protection declaration.

2. By registering on , you can create a customer profile. Purchase data can be used by means of the profile. The customer data collected may be used by Made in Maple SARL for marketing and advertising purposes and for statistical purposes (e.g. market research).

3. Whatever the nature of the personal data concerning you that we may become aware of, either because we are entitled to request it from you in accordance with these GTCS, or because we record it automatically, we shall do everything in our power to treat it with the strictest confidentiality, to ensure its protection and to use it only to carry out your requests or to improve the services that may be offered to you.

4. The customer's personal data (surname, first name, address, e-mail address and telephone number) may be passed on to external service providers, in particular for shipping purposes, but under no circumstances will they be sold to third parties.

12. Governing law and Place of jurisdiction

1. These General Terms and Conditions of Sale are subject to change at any time. Swiss law shall apply exclusively. The parties agree that the exclusive place of jurisdiction is the registered office of Made in Maple Sàrl in Morat.
